These Terms of Service (“Terms”) govern your access to and use of Whitewatr and the websites, services, and features we provide at whitewatr.com (collectively, the “Service”). By using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. What Whitewatr is
Whitewatr is a directory and booking platform that helps travelers discover whitewater rafting outfitters and trip companies (“Operators”) and, where an Operator has enabled it, book and pay for trips online. Whitewatr is not a rafting outfitter and does not operate trips. Operators are independent businesses solely responsible for the trips, services, safety, staffing, equipment, and information associated with their listings.
2. Listings and directory data
Some listings are compiled from public sources and may contain errors or be out of date. We work to verify listings against permits, licenses, and association records, but we make no guarantee about the accuracy, completeness, or availability of any listing. An Operator may claim and edit its listing for free. Information you submit must be accurate and must not infringe anyone’s rights.
3. Bookings and payments
When you book a trip through Whitewatr, you are entering into a contract directly with the Operator. The Operator is the merchant of record for your trip. Payments are processed by Stripe; for online bookings the Operator connects its own Stripe account and Whitewatr charges a platform fee on each transaction. Deposits, balances, cancellations, refunds, age and weight limits, and trip requirements are set by the Operator. Review the Operator’s policies before booking. Whitewatr is not responsible for an Operator’s acts, omissions, cancellations, or refund decisions.
4. Operator accounts and subscriptions
Claiming a listing and the operator dashboard are free. Optional paid placements (for example, Featured listings) are billed on a recurring basis and may be cancelled at any time, effective at the end of the current billing period, unless stated otherwise at checkout. Operators are responsible for the content they publish and for complying with all laws, permits, and licensing applicable to their business.
5. Acceptable use
You agree not to misuse the Service, including by scraping at scale, submitting false or spam content, interfering with the Service, attempting to access accounts or data that are not yours, or using the Service to violate any law. We may suspend or remove access or content that violates these Terms.
6. Disclaimers
Whitewater rafting carries inherent risks. The Service and all listing information are provided “as is” without warranties of any kind, to the fullest extent permitted by law. Whitewatr does not endorse any Operator and does not guarantee the safety, quality, or availability of any trip.
7. Limitation of liability
To the fullest extent permitted by law, Whitewatr and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of the Service or from any trip booked through an Operator. Our total liability for any claim relating to the Service will not exceed the amount you paid to Whitewatr (not to an Operator) in the twelve months before the claim.
8. Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected by updating the date above. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
